Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Creator Offload platform and API. By using Creator Offload, you agree to comply with this policy. This AUP supplements and is incorporated into the Creator Offload Terms of Service.

We have written this policy plainly. The intent is to describe what Creator Offload is built for, what it is not built for, and the obligations you take on when you use it to manage creator content on behalf of a brand, agency, or platform.

1. Purpose of the Platform

Creator Offload is designed for B2B use by brands, agencies, and platform operators managing UGC (user-generated content) workflows. Legitimate uses include:

  • Managing creator content intake, review, and approval workflows
  • Tracking content usage rights and expiration
  • Organizing and exporting ad-ready creative assets
  • Integrating creator content operations into third-party tools via the API
  • Running branded creator portals for content submission

2. Prohibited Content

You may not upload, store, transmit, or process any content through Creator Offload that:

2.1 Illegal Content

  • Violates any applicable law or regulation, including laws regarding copyright, defamation, privacy, and export controls
  • Constitutes or facilitates illegal activity of any kind

2.2 Harmful or Exploitative Content

  • Depicts, promotes, or facilitates child sexual abuse material (CSAM) or the sexual exploitation of minors in any form. Violations will be reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement.
  • Depicts non-consensual sexual activity
  • Promotes or facilitates human trafficking, forced labor, or exploitation

2.3 Deceptive or Fraudulent Content

  • Is fraudulent, deceptive, or intentionally misleading
  • Constitutes or facilitates spam, phishing, or social engineering attacks
  • Impersonates any person, business, or brand without authorization

2.4 Malicious Code

  • Contains viruses, malware, ransomware, spyware, adware, or any other malicious or harmful code

2.5 Intellectual Property Violations

  • Infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party
  • Uses creator content beyond the scope of rights recorded in the platform

3. Creator Data Handling Obligations

When you use Creator Offload to process content and personal data from third-party creators, you accept the following obligations:

3.1 Lawful Basis for Processing

You must have a lawful basis to collect and process each creator's personal data. This typically means you have obtained informed consent from the creator, or you have a contractual relationship with them that covers the processing you perform through the platform.

3.2 Accurate Rights Records

You are responsible for ensuring that the usage rights, expiry dates, and consent records you enter or import into the platform accurately reflect the agreements you have with creators. Creator Offload provides tools to record and track rights — using those tools does not substitute for obtaining the underlying rights from creators.

3.3 Honoring Restrictions

You must honor any usage restrictions, geographic limitations, expiry dates, or other conditions associated with creator content as reflected in your records on the platform. Exporting content for use beyond its recorded rights scope is a violation of this policy and your obligations to the creator.

3.4 Creator Communications

If you use Creator Offload's creator portal or messaging features to communicate with creators, you must not use these channels to deceive creators about the nature or scope of the content agreement, pressure creators to waive rights they have not agreed to waive, or send unsolicited commercial messages unrelated to an active content collaboration.

3.5 Data Minimization

Collect and store only the creator personal data that is necessary for the content workflow. Do not use Creator Offload as a general-purpose database for personal data unrelated to your UGC operations.

4. Intellectual Property

4.1 Your Obligations

You represent that you have all rights necessary to upload content to Creator Offload and to use the platform to process that content. You are responsible for obtaining appropriate licenses, releases, or permissions from creators, talent, third-party rights holders, and any other parties whose intellectual property is contained in the content you manage through the platform.

4.2 DMCA and Copyright Notices

Creator Offload respects intellectual property rights. If you believe that content stored in a Creator Offload workspace infringes your copyright, you may submit a DMCA takedown notice to legal@creatoroffload.com. Counter-notices will be handled in accordance with the DMCA process.

4.3 Creator Offload Intellectual Property

Our platform, API, documentation, trademarks, and all content we provide are proprietary to Creator Offload Pte. Ltd. You may not copy, reverse engineer, decompile, disassemble, or create derivative works from Creator Offload's software or content without express written permission.

5. API Usage and Rate Limits

5.1 Authorized Use

API access is granted for integration with your own internal systems and authorized third-party tools. You may not resell, sublicense, or provide API access to third parties as a standalone service without a separate written agreement with Creator Offload.

5.2 Rate Limits

API usage is subject to rate limits that vary by subscription tier and are documented in our API reference. Rate limits exist to ensure fair access and platform stability for all customers. Do not attempt to circumvent rate limits by rotating credentials, using multiple accounts, or other technical means.

5.3 No Degradation of Service

You must not use the API in ways that impose excessive or unreasonable load on Creator Offload's infrastructure or that degrade the performance of the platform for other users.

5.4 Credential Security

You are responsible for the security of your API tokens and OAuth credentials. Do not embed API tokens in publicly accessible code repositories or client-side applications. If a token is compromised, revoke it immediately from your account dashboard.

6. Security and Platform Integrity

You must not attempt to:

  • Probe, scan, or test the vulnerability of any Creator Offload system without prior written authorization
  • Bypass or circumvent authentication, access controls, or security features
  • Access accounts, data, or workspaces belonging to other customers
  • Interfere with or disrupt the integrity, performance, or availability of the platform or its infrastructure
  • Conduct denial-of-service attacks or distribute attack tools
  • Inject malicious code, scripts, or unauthorized automation into the platform

7. Compliance with Laws

You are responsible for ensuring that your use of Creator Offload complies with all applicable laws and regulations in the jurisdictions where you operate. This includes:

  • Privacy and data protection laws (GDPR, CCPA, and similar)
  • Advertising standards and regulations in the markets where you run campaigns
  • Influencer marketing disclosure requirements (e.g., FTC guidelines in the US)
  • Export controls and sanctions

Creator Offload does not provide legal advice. If you are unsure whether a particular use of the platform is lawful in your jurisdiction, consult qualified legal counsel.

8. Enforcement

We may investigate suspected violations of this AUP. If we determine that a violation has occurred, we may take one or more of the following actions depending on the severity:

  • Issue a warning and request remediation
  • Temporarily suspend access to the Service or specific features
  • Remove content that violates this policy
  • Terminate the account and agreement
  • Report violations to law enforcement where required by law or warranted by the nature of the violation

We will attempt to give customers an opportunity to address issues before taking drastic action, except in cases involving illegal content, imminent harm, or platform security risks.

9. Reporting Violations

If you become aware of content or activity on Creator Offload that violates this policy, please report it to trust@creatoroffload.com. Include as much detail as possible. We will investigate all credible reports.

10. Changes to This Policy

We may update this AUP from time to time to reflect changes in our Service, technology, or legal landscape. Material changes will be communicated with at least 14 days' advance notice via email or in-app notification.
